Effective Date: 09.12.2024

1. Acceptance of Terms

By downloading, installing, or using this preview version of the software "Service Bus Explorer Pro" ("Software"), you agree to this Preview License Agreement ("Agreement"). If you do not agree, do not use the Software.

2. Licensor

The Licensor is sharpbyte e.U., the sole owner and provider of the Software. All rights, title, and interest in the Software remain with the Licensor.

3. License Grant

The Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Software free of charge during the preview period, exclusively for testing and evaluation purposes. This license is granted on a per-user basis and requires individual access approval from the Licensor. This license permits use in both commercial and private environments. This is not free software, and no rights beyond those explicitly outlined in this Agreement are granted.

4. Access Requirements

Each individual user must request and receive explicit access approval from the Licensor before using the Software. Access credentials, download links, and any other means of accessing the Software are strictly personal and may not be shared with other individuals or entities. Sharing access credentials, download links, or attempting to circumvent the individual access requirement is strictly prohibited and will result in immediate termination of the license.

5. Preview Software Disclaimer

This is a preview version of the Software, provided "as-is" and more likely to contain severe defects or issues compared to a final release. The Licensor does not guarantee uninterrupted operation or suitability for any purpose. It is intended exclusively for non-production testing and evaluation and must not be used for critical tasks or in production environments. Use is at your own risk.

6. License Limitations

  • You may not reverse-engineer, decompile, or otherwise attempt to circumvent any technical limitations in the Software.
  • The Software will cease to function after the preview period ends. You are strictly prohibited from attempting to bypass or disable this restriction.
  • You are not permitted to redistribute, copy, or give away copies of the Software to any other party, whether for free or for payment.

7. No Support or Updates

The Licensor is under no obligation to provide technical support, maintenance, or updates for the Software during the preview period.

8. Feedback

Any feedback or suggestions provided by you about the Software will be considered non-confidential and may be used by the Licensor without obligation or compensation.

9. Ownership and Proprietary Rights

All rights, title, and interest in the Software remain with the Licensor. This Agreement does not transfer any ownership rights to you.

10. Termination

The Licensor may terminate your license to use the Software at any time without notice. Upon termination or expiration of the preview period, you must delete all copies of the Software.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Governing Law

This Agreement is governed by the laws of Austria. Any disputes will be resolved exclusively in the courts of Austria.

13. Modifications to Agreement

The Licensor reserves the right to amend this Agreement at any time. Continued use of the Software after changes are made constitutes your acceptance of the updated Agreement.

14. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable.
